IN THE WORKERS' COMPENSATION COURT OF THE STATE OF MONTANA 1994 MTWCC 59A-1 WCC No. 9403-7017 DAVID WILLIAMS Petitioner vs. PLUM CREEK TIMBER COMPANY Respondent/Insurer/Employer. ORDER AWARDING COSTS On June 28, 1994, this Court issued its findings of fact, conclusions of law and judgment finding the petitioner to be entitled to permanent partial disability benefits and costs in an amount to be determined. Petitioner's affidavit of costs and respondent's objection to petitioner's affidavit of costs were filed on July 7, 1994. Respondent objects to the deposition fee of Dr. Ingham and to the transcription of the Court's bench ruling pursuant to the Supreme Court ruling in Baeta v. Don Tripp Trucking, 254 Mont. 487, 839 P.2d 566, (1992). The respondent's objections are granted. IT IS HEREBY ORDERED that respondent shall reimburse the petitioner for costs in the sum of $249.00.
