JUDGMENT AND CERTIFICATION

¶1 The Order Denying Motion for Summary Judgment, filed December 7, 1999, was not certified as final due to other outstanding factual issues pending.

¶2 Following a conference call with Court and counsel on January 3, 2000, counsel notified the Court in writing on January 13, 2000, that there were no factual determinations left to be made, and counsel were in agreement that it would be appropriate to certify the decision as final.

¶3 Accordingly, the Order Denying Motion for Summary Judgment, filed December 7, 1999, is hereby certified as final for purposes of appeal pursuant to ARM 24.5.348.

¶4 SO ORDERED.
