Churchill v. Zurich American Ins. Co. [8/22/02] 2002 MTWCC 42 Where Court credited testimony that subluxing ulnar nerve condition was triggered by an industrial blow to claimant's arm, the insurer is liable for the condition and to an 8% whole-person impairment award. The fact that claimant was congenitally predisposed to condition does not preclude liability where the accident triggered or lit it up. |
