Evidence: Expert Testimony: Psychologists
EBI/Orion Group v. Blythe, 281 Mont. 50, 931 P.2d 38 (1997) While the WCC erred in ordering an IME by a psychologist who was neither a medical doctor nor licensed to practice in Montana, the Court could properly consider opinions rendered by a clinical psychologist who did not conduct an IME and was thus not subject to the exclusive definition of "treating physician" within sections 39-71-605 and -116(30), MCA (1993) where the opinion of the psychologist were not challenged in the lower court. |
