Employers: Relationship Test: Right or Exercise of Control

Howe v. UEF [07/07/06] 2006 MTWCC 27 In a case in which a claimant stated that he worked at the direction of a contractor’s company, the claimant reported to that contractor when the contractor was on the job site, and the claimant was working at the direction of that contractor at the time of his industrial accident, the contractor had the right to direct the claimant and undisputably exercised that right. The evidence therefore supports a determination that the claimant was the contractor’s employee.
