SAMUEL J. GRENZ Petitioner vs. FIRE AND CASUALTY OF CONNECTICUT Respondent.
Petitioner has filed a Petition for Judicial Control over proceedings before the Montana Department of Labor and Industry (DLI). The petition is separate and apart from a Notice of Appeal simultaneously filed by petitioner and designated in WCC No. 9401-7224. The Petition for Judicial Control apparently arises in connection with an occupational disease proceeding before the DLI, the same proceeding which is the subject of the Notice of Appeal. That proceeding has been completed and the Notice of Appeal is sufficient to invoke this Court's power to judicially review the DLI procedures and result. Petitioner does not identify any other pending proceedings. Thus, he has failed to identify any ongoing proceeding over which the Court could exercise control. Accordingly, the Petition for Judicial Control is dismissed. Dated in Helena, Montana, this 30th day of January, 1995. (SEAL) /s/ Mike
