[03/27/08] 2008 MTWCC 14 Where Petitioner’s attorney contacted Respondent’s case manager and requested that Respondent reconsider its denial of liability, Respondent replied that Petitioner “can proceed to the Work Comp Court” and Petitioner’s attorney obliged by filing a petition with this Court, Petitioner’s attorney is entitled to receive his attorney fee even though Respondent claims that it paid benefits based upon a case recently issued by this Court and not due to any efforts made by Petitioner’s attorney.
