Benefits: Rehabilitation Benefits: Rehabilitation Plan: Duress
Thompson v. Liberty Northwest Ins. Corp. [6/12/02] 2002 MTWCC 34 While duress may be a basis for annulling a rehabilitation plan, the claimant must show that the insurer or rehabilitation provider took unfair advantage of claimant. Where claimant was assertive in his contacts with the rehabilitation provider and decided on his own rehabilitation plan, there was no duress and claimant is bound by the plan. |
