ORDER DENYING MOTION TO COMPEL

On September 30, 1998, counsel for petitioner, Mr. Chris J. Ragar, filed a MOTION TO COMPEL with supporting brief. In its response to the motion, Montana Power Company stated that it responded to petitioner's discovery requests on September 29, 1998. Thus, the discovery answers and the motion crossed in the mail. That being the case, the motion is deemed moot and petitioner's request for costs on the motion is denied.
